ARCHITECTURAL REVIEW COMMITTEE

CHARTER

 

            The Western Shores 2nd Addition Association Inc. Board of Directors, under the authority granted by the Amended and Restated By-Laws of said Association under Article Eight Para. 5, hereby appoint an Architectural Review Committee, otherwise known as ARC.  The purpose of the ARC is to maintain the integrity of the desirable lifestyle that the members presently enjoy.

 

            The ARC shall consist of three (3) members appointed by the Board of Directors.  Each member will serve at the pleasure of the Board.  Any member may resign at any time by giving written notice to the Board of Directors and shall take effect upon receipt thereof by the Board of Directors.  Acceptance of such resignation shall not be necessary to make it effective.

 

            The role of the ARC is oversight.  Any action suggested by the Committee may only be taken at the discretion of the Board of Directors. 

 

DUTIES OF THE ARC

 

1.         The Committee shall confirm that a prescribed Architectural Review Application is completed and delivered to the ARC by the applicant prior to the commencement of any work.

 

2.         The ARC shall confirm that the proposed work shall be done in accordance with the Western Shores 2nd Addition Association Declaration of Restrictions, and, if so, approve the application.

 

3.         The ARC shall monitor said work to insure compliance with the application.

 

4.         Upon completion of the work, the ARC shall confirm that the completed work was done under the terms of the approved application.

 

            Any action deemed necessary by the ARC to assure that compliance with this procedure is followed shall be presented to the Board of Directors in writing, and the Board of Directors shall determine whatever remedy is appropriate.

 

5.         The ARC shall meet from time to time as the members deem necessary.

 

6.         At least one member of the ARC shall attend each regular Board of Directors meeting and provide a Committee report to the Board.

 

This Charter is hereby ratified by the Western Shores 2nd Addition Association Inc. Board of Directors.
